An Appleton, Wis., man accused of shooting his brother in the back inside the Oneida Casino parking garage after allegedly consuming 12 shots of tequila and two margaritas has been charged with attempted first-degree intentional homicide with use of a dangerous weapon.

Long Thao, 39, was also charged Monday with possession of a firearm by a felon, possession of a firearm contrary to an injunction, endangering safety by use of a dangerous weapon while intoxicated, and resisting an officer by failing to stop his vehicle.
The shooting occurred early Saturday at the Green Bay, Wis. casino, according to a criminal complaint filed in Brown County Circuit Court. Police were called at about 1:53 a.m. after dispatchers were told a man had been shot by his brother on the second level of the parking garage.
The victim, identified in court papers only by initials, was found by police and casino security with a gunshot wound to the middle of his back, according to the complaint. He was treated at the scene and taken to a local hospital. Authorities have not released an update on his condition.
The allegations about Thao’s alcohol consumption came from the victim’s account to police.
Brothers’ ‘History’
The incident followed a night of drinking and gambling, prosecutors allege. The victim told police he arrived at the casino around 10:30 p.m. Friday in his own vehicle, while Thao and two women arrived in Thao’s white Honda Accord.
Around 1 a.m., the victim told police, Thao began talking about “history” between the brothers and tried to start an argument. Thao then asked him to go to the parking garage. The victim said he believed this was so they could talk privately.
Once they were near Thao’s car, the victim said, Thao opened the driver’s side door, grabbed a small chrome handgun, and cocked it. The victim told police he asked Thao what he was going to do with the gun, then said he was not dealing with it and turned to walk away.
After two steps, the victim said, Thao shot him in the back.
Casino surveillance video then showed Thao standing over the victim while holding the gun before getting into the Honda and leaving, according to prosecutors.
“Long then stood over me and pointed the firearm at my head,” the victim told police. “The gun was 3ft away from my head. I told Long ‘I love you.’ I thought I was going to die. Long’s intentions were to kill me. Long very intentionally shot me to end my life. Long walked to the vehicle, put the gun away and drove away.”
Police Chase
A Brown County sheriff’s deputy later spotted a white Honda Accord matching the suspect vehicle traveling east on State Highway 172, according to the complaint. The deputy said the vehicle did not stop when emergency lights and sirens were activated, prompting a pursuit.
Deputies conducted a high-risk stop and arrested Thao. A handgun was found on the passenger seat, according to the complaint.
The deputy who dealt with Thao reported that his eyes were red, bloodshot, glassy, and droopy, his speech was slurred and slow, and he smelled strongly of alcohol.
Thao refused field sobriety tests and a preliminary breath test, according to the complaint. When read his Miranda rights, he said he was too intoxicated to understand them, prosecutors allege.
Thao was barred from having a gun at the time because of a prior felony conviction and a domestic abuse injunction, according the complaint.
A Brown County court commissioner set Thao’s cash bond at $750,000.
