A man with pending domestic assault case charged in new case allegedly involving a knife

An Austin man with a pending case of felony domestic assault, has been arrested and charged in a new case.

Gabriel Monroe Graham, 25, has been charged with five felony counts related to a case involving a knife earlier this month. Those counts include second degree assault, domestic assault, threats of violence, violation of a domestic abuse no contact order (DANCO)-possession of a dangerous weapon and violation of a no contact order within 10 years of the first of two or more convictions.

Graham made a first appearance in Mower County District Court Wednesday with an initial appearance scheduled for Aug. 25.

According to the court complaint, Austin Police Department officers were dispatched to the 200 Block of Second Street SE at a little after 1 a.m. on Aug. 12 on a report of a domestic assault involving a knife.

Upon arriving on scene, officers made contact with the victim and detained Graham, who was in the victim’s apartment, despite the DANCO from the previous case that prohibits Graham from being in touch with the victim either directly or indirectly and placed on Graham on Jan. 17.

In that case Graham has been charged with two felony counts of domestic assault on top of a line of previous convictions for misdemeanor domestic assault in Steele County and violations of two contact orders in Mower County just this year. He also has a domestic violence-related juvenile adjudication for fifth degree assault dating back to March 30, 2016.

In this current case, the victim told police that her and Graham began arguing at around 8:30 p.m. on Aug. 11, which escalated to the point that Graham allegedly told the victim, “I will viciously attack you,” while holding a knife over this head, which was later found in a kitchen sink. 

The victim also said that Graham allegedly said “If someone comes in, I’ll kill them.”

The victim then locked herself in a bedroom and barred the door to Graham who attempted to get in, but failed.

In text messages to another, the victim stated that she was scared, while another witness stated that she too heard Graham allegedly state “I will viciously attack you.”

When talking with police, Graham stated that the victim told him several times to leave, but he refused stating he had taken sleep medication.
